The Critical Role of Representation in the Workplace/Practical Approaches


CSEA Job Stewards / Chapter Officers should be prepared to take on the duty of representing workers at least at the initial step of discipline. Often that involvement will be limited to interviewing the member regarding the issue at hand. In many cases a final outcome will not be determined in the initial meeting. However, in some cases the matter may be fully concluded at that meeting.

It is very important to keep in mind that the Right to Union Representation is only available to those workers covered under Collective Bargaining Agreements (Contracts.) Listed are the rights provided only to Union members:

If a supervisor calls you into a meeting, you may have reason to have your union representative present. These are your rights:
  • You have the right to know the purpose or subject of the meeting.

  • If you think the meeting might lead to discipline, reprimand or dismissal, you have the right to union representation.

  • Immediately notify your job steward or other union representative of your meeting with management.

  • If the purpose of the meeting is investigatory and could lead to discipline and you have requested union representation, the employer must stop the meeting or reschedule it until a representative is present.

  • You must ask for union representation. The employer does not have to advise you of you rights.

  • If you request union representation and it is denied, you have the right to refuse to answer any questions that could be used against you. However, do NOT refuse to attend the meeting. CONTACT your representative immediately.
While these rights are very important, it is also important that the Job Steward or Chapter Officer assist the member in maintaining composure, and in framing discussion in a manner that best represents the member in the initial meeting.  In terms of accomplishing this goal, point one is key; the purpose of the meeting.

Once this has been determined, the Job Steward may request a caucus (break) and speak with the member privately regarding the issue. In this process the issues can be clarified and important factors can be discussed regarding the response by the employee.

The Job Steward may request that the Employer continue with the discussion of the matter. Upon conclusion, the member should be prepared to respond to the issue, including bringing forward any extenuating circumstances or mitigating factors relating to the incident. At this point the parties may explore possible resolutions to the issue. It is important to involve the member in the discussion, in terms of what resolution is acceptable to them.

Important: At any stage of the process you may contact your Labor Relations Representative for direction. Matters of serious nature or any potential criminal issues should be deferred to the CSEA Labor Relations Representative for guidance.
