As we prepare to return to work for another year, some CSEA members will be welcoming new classified co-workers who are beginning their classified careers. Often these new workers are unfamiliar with the protections available to them under the California Education Code (“Ed Code”).

Click on "read more" for a summary of the protections and rights available to classified employees by the California Education Code.  As you begin another school year,  consider taking a moment to inform the new hires not only of the protections available to them under the California Education Code, but also to remind them that it was the work of CSEA activists which led to the enactment of many of the rights available under the Code. Caution: Be sure to consult your Chapter and Labor Relations Representative as your contract may contain protections even stronger than those in the Ed Code.

Probationary Period: New co-workers serving in bargaining unit positions will likely initially be hired as probationary employees – meaning that they must work in their position for a certain number of days before becoming permanent members of the classified service. For workers in Non-Merit Districts, CA Ed Code Section 45113 indicates that probationary periods are to be no longer than one-year. For most workers employed by Merit Districts, CA Ed Code Section 45301 limits the duration of a probationary period to the greater of six months or 130 days of paid service. If you aren’t already aware of the probationary period at your job, consult your contract, Chapter Leaders, and your LRR to learn of the specific duration of the probationary period in your district.

Fixing of Duties: According to Ed Code Section 45109 – the governing board of a school district shall “fix and prescribe” the duties to be performed by the classified service. In general, new classified co workers can find their list of fixed and prescribed duties memorialized in their position’s job description. It may be helpful to inform new co-workers of the components of their job description so they know what work is properly assigned to them.  To get a copy of a particular job description for a new classified co-worker, contact your Chapter Leadership or your LRR.

Payroll Errors: Mistakes happen and sometimes mistakes happen on the paychecks of classified employees. Fortunately, Ed Code Section 45167 provides that errors in the payment of a classified employee’s salary shall be corrected by the District within five (5) workdays following such determination so that the affected employee receives both a statement of correction as well as a supplemental check to correct the error.

Personnel Files:California Labor Code Section 1198.5 grants an employee the ability to access her/his Employer’s personnel records related to that employee’s job performance. Ed Code Section 44031 gives classified employee additional rights regarding their personnel files including the right to respond to any negative comments/criticisms before such information is entered into an employee’s Personnel File. While employees new to a district often may not begin their careers wary of the tactics an employer may engage in to affect their careers, as committed CSEA activists many classified employees recognize the value of informing co-workers of their rights before there is a problem.For more information on the specific code references in this article, contact your chapter leader, LRR and the following website: http://www.leginfo.ca.gov/calaw.html.
